The Board of Appeals hears requests concerning
variances and interpretations pertaining to the Zoning Ordinance.
The Board consists of 7 members appointed by the Mayor with the
approval of the Council. The Board of Appeals' decisions are not
referred to the City Council. The Board meets on the first Monday of
each month, if applications have been filed for consideration, at
7:00 p.m. in the Council Chambers of the City Hall, 300 S. Whittle,
Olney, IL. The meetings are open to the public. In order to process
and publish a request, an application must be submitted to City Hall
at least 19 days prior to the Board of Appeals meeting.
There is a fee of $50.00 for all applications for processing,
publishing and postage costs. Any amount over the fee will be billed
to the applicant.
Notices regarding the request will be sent to adjoining property
owners. Information regarding the name of adjoining property owners
will be completed by City Hall staff.
Applicants are required to attend the hearing. If the applicant
fails to appear, the request can either be denied or postponed. In
order to process and publish a request, an application must be

The Planning Commission hears requests concerning
zoning, special uses, continuances of non-conforming uses,
consideration for preliminary and final plats for subdivisions and
planned unit developments and amendments pertaining to the zoning
ordinance and subdivision control ordinance. The Planning
Commission's function is to hear requests so a recommendation can be
given to the City Council for final consideration.
The Planning Commission consists of 9 members appointed by the Mayor
with the approval of the Council. Meetings are held on the first
Monday of each month at 7:30 p.m. in the Council Chamber of City
Hall, 300 S. Whittle, Olney, IL and are open to the public.
In order to process and publish a request, an application must be
submitted to City Hall at least 19 days prior to the Planning
Commission meeting.
There is a fee of $100 to file a Special Use Permit application and
a $50.00 fee for all other zoning request for processing, publishing
and postage costs. Any amount over the fee will be billed to the
applicant.
Notices regarding the request will be sent to property owners within
200 feet of the subject property. Information regarding the name of
surrounding property owners will be completed by City Hall staff.

On March 25,
1996, the City Council passed Ordinance 96-19 creating a tree
commission and regulating the planting, maintenance and removal of
trees, shrubs, and other plants.
The City Park Supervisor, or
other City staff as assigned by the City Manager, shall act as
support staff for the Tree Board to assist it in carrying out its
various responsibilities. The Board shall study, investigate,
counsel and develop and/or update annually and administer a written
plan for the care, preservation, pruning, planting, replanting,
removal or disposition of trees and shrubs in parks, along streets
and in other public areas.
The ordinance lists official street tree species for planting in
Olney. No species other than those included in this list may be
planted as street trees without written permission of the City Tree
Board.
The City has the right to cause the removal of any dead or diseased
tree on private property within the City, when such tree constitutes
a hazard to life and property or harbor insects or disease which
constitute a potential threat to other trees within the City.
It shall be unlawful for any person or firm to engage in the
business or occupation of pruning, treating, or removing street or
park trees within the City, without first applying for and procuring
a license. The license fee shall be $25.00 annually in advance;
provided, however, that no license shall be required of any public
service company or City employee doing such work in the pursuit of
their public service endeavors. Before any license shall be issued,
each applicant shall first file evidence of possession of liability
insurance in the minimum amounts of $50,000 for bodily injury and
$100,000 property damage indemnifying the City or any person injured
or damaged resulting from the pursuit of such endeavors. |
